Sheriff: Woman vomits drugs, swallows them again after arrest

BUFFALO, N.Y. (WIVB) — The Erie County Sheriff’s Office says a woman swallowed a series of inedible items before getting arrested and taken to the County Holding Center.

Ruby Gerland was arrested on March 8. At some point before then, deputies say she swallowed ten baggies of heroin, an “8 ball” of cocaine, a lighter and a glass pipe.

She proceeded to vomit up all but the lighter on March 10 before reingesting the items days later, authorities say. The lighter was allegedly discovered through a bowel movement.

According to the Sheriff’s Office, the day after she swallowed them again, she admitted to a deputy that she had ingested the items before her arrest.

Gerland was taken to ECMC for a medical procedure. She’s remanded to the Holding Center on $25,000 bail for petit larceny, criminal possession of a controlled substance and endangering the welfare of a child.

More criminal, as well as administrative charges, are pending.

Empire Center: Single Payer “Sticker Shock”

A new report from the Empire Center for Public Policy details how expensive a single payer healthcare system would be in New York. The full report is available here.

The report notes that the New York Health Act (NYHA) would radically reform New York’s tax structure. The bill calls for a “progressively graduated” tax on both income and payroll; however, the exact rates are not specified in the legislation. This is, in part, because the bill sponsors are also unaware of how much revenue the state would need to finance a single payer healthcare system. However, the latest estimate by the RAND Corporation is that New York would need an additional $157 billion in revenue to operate a single payer system. By removing cost controls, this number could grow.

Raising this revenue would require the largest tax increase in history. The report estimated that, to raise the needed revenue, the top tax rate would increase to 36% — which would be three times the top rate in California, the state with the second highest tax rate. New York would become an extreme outlier in taxes.

NYHA advocates claim that while taxes would increase under the NYHA, premiums would lower, leading to a net savings for many New Yorkers. The RAND Corporation estimates that such a tax structure would mean 65% of New Yorkers end up saving money, 4% pay about the same, and 31% see additional costs. Although this may appear more progressive initially, the report notes that NYHA would add significant incentives for outmigration, especially among top earners and high-producing businesses. Losing top taxpayers would shift more of the cost burden onto middle and lower income families, eliminating the bill’s intended benefit.

In years where healthcare costs increase or state revenues decrease, taxpayers would face significant pressure and additional tax hikes to keep the NYHA system solvent.

Lastly, the report notes that the NYHA would cause concern for doctors and medical providers, who would experience income changes that may repel them from New York.

The report details the concerns that the BNP and employers have raised since the NYHA was introduced three decades ago. The NYHA would dramatically increase taxes for many businesses and families, create incentives for outmigration, and discourage medical professionals from practicing in our state.

Security officer assaulted by patient with warrant at NFMMC

NIAGARA FALLS, N.Y. (WIVB) — A 19-year-old security officer was assaulted by a patient at Niagara Falls Memorial Medical Center, according to a report from Niagara Falls police.

The incident allegedly happened on Wednesday afternoon. Police say that nurses called the officer to help them give medication to 24-year-old Ashton Pochatko.

Pochatko, who police say proceeded to aggressively leave the room after the nurses, allegedly struck the guard in the left eye after he jumped in front of the nurses. According to the police report, Pochatko is accused of using “personal weapons.”

Pochatko, who police say appears to have a mental disability, has since been charged with assault. After running his name through a search of warrants, it was discovered that he had one out of Niagara Falls.

Once he was in custody, Pochatko was jailed. According to police, Pochatko “believes he is a sovereign citizen” who “will fight police.”

3.17.22 Advocacy Alert: Hochul Extends State of Emergency, Signs Sexual Harassment Bills

State of Emergency Extended 

Governor Kathy Hochul has issued an Executive Order extending New York’s state of emergency declaration for COVID-19. The state of emergency was scheduled to expire today, but Hochul extended the declaration through April 15.  

Declaring a state of emergency triggers the NY HERO Act, meaning employers must continue to abide by a number of disease prevention measures.

The extension comes as New York has its lowest number of positive COVID cases since July.   

Hochul Signs Sexual Harassment Prevention Legislation 

Yesterday, Governor Hochul signed into law a package of legislation to combat sexual harassment in the workplace.  

One bill will create a confidential hotline within the state’s Division of Human Rights for the purpose of reporting workplace sexual harassment. DHR will connect callers to pro-bono attorneys, who can apprise callers of their rights and give legal advice.  

Another bill clarifies that leaking an employee’s personnel records because he or she has made a complaint about workplace harassment constitutes unlawful retaliation. The bill is a jab at former Governor Cuomo, whose administration leaked unflattering personnel records of Lindsay Boylan after she accused Cuomo of sexual harassment.  

The signing of this legislative package serves as a reminder to employers of their responsibilities to combat workplace sexual harassment. All employers are required to provide anti-harassment training and adopt a sexual harassment prevention policy. Resources for preventing sexual harassment are available here

Today, she is committed to fostering talent, community advocacy and diversity initiatives. Active in her community, Christine serves on the board of directors for the Boys & Girls Clubs of Buffalo. Among her many volunteer roles, Christine also serves as an active American Advertising Federation (AAF) of Buffalo member, as well as an active mentor through the Western New York Women’s Foundation’s Women Who Lead mentorship program. 

We asked Christine a series of questions to get to know her better.

Best Piece of Advice Given Regarding Her Career 

 Be in the moment, always. 

 Advice to Give to a Woman Just Starting in the Workplace. 

 Be mindful of how often you apologize. Use an apology only when it is needed. It’s ok to be not ok, and it’s ok not to know. Own that and ask. Ask for help, ask for guidance but don’t apologize.

Box truck driver killed in crash on Walden Avenue

ALDEN, N.Y. (WIVB) — A driver was killed in a crash on Walden Avenue in Alden Thursday morning.

Shortly after 3 a.m., the commercial box truck driver, who has not been named by law enforcement, left his lane, hit a utility pole and stopped on the bank of Ellicott Creek. This was witnessed by a correction officer who was on perimeter patrol at the time.

It’s believed that a medical-related event may have led to this.

As a result of the crash, Walden Avenue has been shut down between Wende and Zoeller roads. It’s not yet clear when it will reopen.

See how Colleen Pandy and Jill Cannan inspire women to go for their dreams no matter what

BUFFALO, N.Y. (WIVB) — The month of March is the time to recognize the contributions of women all across the world, and right here in the Queen City, Colleen Pandy and Jill Cannan are making history.

Five years ago, both women were stay-at-homes who wanted to do something creative that enabled them to be home with their families when it mattered most. Soon after, the two launched their original studio which turned into three, ultimately rebranding into loaded lumber and going nationwide.

Today, the business can be found in fifteen cities across the country and their message to young women struggling with choosing between motherhood and career goals is that you don’t have to choose.

“You can do both.” says Cannan, “Set the sky for your limit. [We want to show] this new generation that it’s possible.”

Pressure Drop Brewing expands into North Buffalo

BUFFALO, N.Y. (WIVB) — A brewery here in the Queen City has just expanded into North Buffalo.

Pressure Drop Brewing is in the Old Papa Jake’s on Elmwood Avenue near Amherst Street. They offer food including sliders and fries, along with their own brand of beers, plus wine, liquor and New York cider.

The response for their first night has been strong.

Plus, once warmer weather settles in they’ll open a patio and remember to watch for special events there to mark Buffalo Brewers’ Week in June.
